Acceptance of Terms

By downloading or using any application published by Ergo Sum ("we", "us", "our"), you agree to be bound by these Terms of Use. If you do not agree, please do not use our apps.

Use of Our Apps

Our apps are provided for your personal, non-commercial use. You may not reverse-engineer, decompile, or otherwise attempt to extract the source code of our applications.

In-App Purchases

Some of our apps offer optional in-app purchases. In Midnight Society, the Doomsayer role is available as a one-time purchase for $2.99 (USD).

• All purchases are processed by Apple through the App Store.
• Purchases are non-consumable and tied to your Apple ID.
• You can restore previous purchases from within the app.
• All sales are subject to Apple's refund policies. To request a refund, contact Apple Support.

Maintenance & Support

Ergo Sum is solely responsible for providing maintenance and support for our apps. Apple has no obligation to furnish any maintenance or support services with respect to our apps. For support, contact us at support@ergosum.studio or visit our support page.

Disclaimer of Warranties

Our apps are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Apple has no warranty obligation whatsoever with respect to our apps.

Product Claims

Ergo Sum, not Apple, is responsible for addressing any claims relating to our apps, including but not limited to product liability claims, any claim that an app fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

Intellectual Property

In the event of any third-party claim that one of our apps or your use of it infringes a third party's intellectual property rights, Ergo Sum, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

Limitation of Liability

To the fullest extent permitted by law, Ergo Sum shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our apps.

Legal Compliance

You represent and warrant that you are not located in a country that is subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Apple as Third-Party Beneficiary

You acknowledge that these Terms are between you and Ergo Sum only, not with Apple. Apple is not responsible for our apps or their content. However, Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance, Apple will have the right to enforce these Terms against you as a third-party beneficiary thereof.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Utah, United States, without regard to its conflict of law provisions.

Changes to These Terms

We may update these terms from time to time. Changes will be reflected by updating the "last updated" date at the top of this page. Continued use of our apps after changes constitutes acceptance of the updated terms.
